Man Gets Probation, Restitution Sentence for Prospect Park Burglaries

Also, an update from a November heroin operation and more Judge Barton news.

The following results are from recent hearings held in the Caste Village office of Magistrate David J. Barton of District Court 05-2-17:

 

Whitehall Borough Charges

  • Whitehall Borough police charged Jonathan Michael Kalb, 28, of 1703 Roosevelt Rd. in Ohio Township, with four counts each of burglary and theft stemming from Wallace (Prospect) Park-area incidents between July 9 and 29. Barton held Kalb's charges on Aug. 14, and Kalb faced those charges at the Allegheny County Courthouse on Sept. 27. He then had an Oct. 26 pretrial conference, which resulted in a Nov. 1 non-jury trial and a sentence of $4,150 in restitution, two years of probation, and a drug and alcohol evaluation.

 

  • Whitehall police charged Donald Dwyer, 22, of 1218 Rossner Ave. in Duquesne, with attempted theft from a vehicle and loitering or prowling at night on July 22. Dwyer's Aug. 14 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on Oct. 30, where he was scheduled for a Dec. 7 pretrial conference.

  • Whitehall police charged Ryan Christopher Brooks, 18, of 3197 Bel Air Dr. in Whitehall Borough, with possession of a controlled substance and possession of a controlled substance with intent to deliver on July 31. Brooks' Oct. 30 hearing before Barton was waived, and he will face those charges at the Allegheny County Courthouse on Dec. 18 (UPDATE: rescheduled for Jan. 28).

 

  • Whitehall police charged Paul Howard Schuetz, 29, of 243 Whitehaven Dr. in Richland Township, with possession of a controlled substance and possession of drug paraphernalia on Sept. 10. Barton withdrew the charges on Oct. 30.

 

  • Whitehall police charged Michael Fazio, 22, of 1838 Parkline Dr., Apt. 13, in the Prospect Park area, with simple assault, harassment and disorderly conduct; Daniel Laplace Jr., 23, of 649 Glowood Dr. in Whitehall, with aggravated assault, disorderly conduct, simple assault and harassment; and Raymond Fleisner, 21, of 1556 Barnes Ave. in South Park Township, and Nathan Reed, 18, of 352 Benson Cir. in Whitehall, with disorderly conduct, all stemming from an incident at Caste Village on June 29. On Aug. 21, Barton withdrew Fazio's assault charge, but his remaining charges were waived for an Oct. 4 hearing at the Allegheny County Courthouse. Fazio then had a Nov. 9 pretrial conference, which has led to a non-jury trial set to begin on Jan. 23. On Aug. 28, Barton withdrew Laplace's aggravated assault charge, but his remaining charges were waived for an Oct. 12 hearing at the Allegheny County Courthouse. Laplace then had a Nov. 21 pretrial conference, which has also led to a Jan. 23 non-jury trial. On Sept. 5, Barton found Reed guilty of his charge and fined him approximately $240. And Fleisner faced his charge before Barton on Sept. 14. He was found guilty and fined approximately $240, as well.

 

  • Whitehall police charged Dominick Mastrogiacomo III, 29, of 8038 Saltsburg Rd. in Plum Borough, with  on Aug. 18. On Aug. 28, Barton withdrew Mastrogiacomo's intent to deliver charge, but his remaining charges were waived for an Oct. 12 hearing at the Allegheny County Courthouse. His case was then part of a Nov. 20 docket conference, where the remaining charges were withdrawn, as well.

 

  • Whitehall police charged Julian Morris, 22, of 1821 Skyline Dr., Apt. 21, in the Prospect Park area, with possession of a controlled substance, possession of a controlled substance with intent to deliver, possession of drug paraphernalia, possession of instruments of crime and criminal conspiracy and Kenneth Anderson, 19, of 1013 Imperial Dr. in South Park, and Clinton Webb, 20, of 207 Parkford Dr. in South Park, with possession of a controlled substance, possession of a controlled substance with intent to deliver, possession of drug paraphernalia and criminal conspiracy, all on Aug. 28. . Barton held Morris' remaining charges on Oct. 9, and Morris faced them at the Allegheny County Courthouse on Nov. 27. He will now have a Dec. 21 pretrial conference.

 

  • Whitehall police charged Marley Fisher, 24, of 5369 Orchard Hill Dr. in Whitehall, with theft on Oct. 19. Fisher's Oct. 30 hearing before Barton was waived, and she will face that charge at the Allegheny County Courthouse on Dec. 18 (UPDATE: rescheduled for Feb. 21).

 

  • Whitehall police charged Brenton Fawcett, 37, of 353 Brookline Blvd., with on Nov. 3. On Nov. 13, Barton withdrew Fawcett's robbery charge, but his remaining charges were waived for a Jan. 3 hearing at the Allegheny County Courthouse.

 

  • Whitehall police charged Joshua Gunter, 24, of 455 Streets Run Rd. in Whitehall, with on Nov. 19. Barton held Gunter's charges on Nov. 27, and he will face them at the Allegheny County Courthouse on Jan. 15.
