Man Gets 1-2 Years After Plea Agreement in Baldwin Rape Case

Jamal Tompkins was charged with raping a mentally disabled girl, but he pleaded guilty only to sexual assault and corruption of minors.

The man whom Baldwin Borough police officers on charges that he raped a mentally disabled girl in south Baldwin in September 2010 has been sentenced to approximately 1-2 years of confinement for sexual assault and corruption of minors.

Jamal Tompkins pleaded guilty to those charges in front of Allegheny County Court of Common Pleas Judge Donna Jo McDaniel on Dec. 10 before McDaniel withdrew nine other charges and issued the sentence. McDaniel also sentenced Tompkins to five years of probation and lifetime registration as a sex offender.

The nine withdrawn charges were rape-forcible compulsion, rape of a mentally disabled person, involuntary deviate sexual intercourse-forcible compulsion, involuntary deviate sexual intercourse with a mentally disabled person, unlawful contact with a minor-sexual exploitation, criminal solicitation-sexual assault, conspiracy-sexual assault, unlawful restraint causing serious bodily injury and false imprisonment.

Baldwin police accused Tompkins, 23, of Zara Street in Pittsburgh's Knoxville neighborhood, and two male juveniles of raping the mentally disabled 17-year-old—formerly a Baldwin High School student—in a vacant apartment at Baldwin's then-Leland Point Apartments complex as she was making her way home from a high school football game.

Because the victim is mentally disabled, she is not able to legally consent to sex, Baldwin police Detective Anthony Cortazzo said.

Tompkins avoided a jury trial by agreeing to plead guilty to the two charges.

This seems like a super lite sentence for what this kid did. Why withdraw all those charges which seem so applicable in this case? People that get caught with pot get more time than this...and this guy and his buddies rape a mentally challenged girl and get 1-2 years?? Has he been locked up all this time so he will get time served and be out in no time?? Is there more to this story?

Why does the law treat sexual assault like a minor crime? It's shameful.

This is a disgrace! The Legislative branch of government needs to set minimum sentences - relative to the crime committed since our Judges refuse to do so.....

no it is sad that he raped a mentally challenged girl. I hope he was raped many times over in prison as he deserved it. They all say they are innocent when they rape even when they brutally rape someone. I am just glad he will be a on megan's list the rest of his life and will make sure everyone knows he is a child molester.

For clarification's sake, the rape charges were withdrawn.

Sexual assault and abuse is any type of sexual activity that you do not agree to, including: Inappropriate touching Vaginal, anal, or oral penetration Sexual intercourse that you say no to Rape Attempted rape Child molestation Sexual assault can be verbal, visual, or anything that forces a person to join in unwanted sexual contact or attention. Examples of this are voyeurism (when someone watches private sexual acts), exhibitionism (when someone exposes him/herself in public), incest (sexual contact between family members), and sexual harassment. It can happen in different situations: in the home by someone you know, on a date, or by a stranger in an isolated place. Rape is a common form of sexual assault. It is committed in many situations — on a date, by a friend or an acquaintance, or when you think you are alone. Educate yourself on “date rape” drugs. They can be slipped into a drink when a victim is not looking. Never leave your drink unattended — no matter where you are. Attackers use date rape drugs to make a person unable to resist assault. These drugs can also cause memory loss so the victim doesn’t know what happened. Rape and sexual assault are never the victim’s fault — no matter where or how it happens.

Robert Edward Healy, III 7:29 pm on Thursday, December 27, 2012 For clarification's sake, the rape charges were withdrawn. Thanks for the reminder/clarification, Bob. I agree there was no justice done for the girl that he only was charged with "sexual assault and corruption of minors." But if you read the definition of sexual assault, then rape is included in it. Any person that does this to a minor should be castrated and never allowed near another child again.

Any time, Bob. Ned E
