Attempted Thief Trapped in Vehicle Gets Probation Sentence

And 12 other courts updates from Whitehall Borough.

The following results are from recent hearings held in the Caste Village office of Magistrate David J. Barton of District Court 05-2-17:

 

Whitehall Borough Charges

  • Whitehall Borough police charged Donald Dwyer, 22, of 1218 Rossner Ave. in Duquesne, with attempted theft from a vehicle and loitering or prowling at night on July 22. Dwyer's Aug. 14 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on Oct. 30, where he was scheduled for a Dec. 7 pretrial conference. He then had a Jan. 23 non-jury trial, where he pleaded guilty to both charges and was sentenced to one year of probation.

  • Whitehall police charged Zwen Ko Ko, 27, of 1680 Skyline Dr., Apt. 4, in Whitehall's Wallace (Prospect) Park area, with assault and making terroristic threats on Jan. 2. Barton granted the withdrawal of those charges on Jan. 22.

 

  • Whitehall police charged James Nhial, 32, of 1600 Skyline, with simple assault and harassment on Aug. 3. Nhial's Sept. 25 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on Nov. 9. He will now have a Feb. 15 pretrial conference.

 

  • Whitehall police charged Brenton Fawcett, 37, of 353 Brookline Blvd., with  on Nov. 3. On Nov. 13, Barton granted the withdrawal of Fawcett's robbery charge, but his remaining charges were waived for a Jan. 3 hearing at the Allegheny County Courthouse. He will now have a Feb. 1 pretrial conference.

 

  • Whitehall police charged Adnan Omeragic, 51, of 4512 W. Barlind Dr. in Whitehall, with driving under the influence of alcohol, public drunkenness, disorderly conduct and obstruction of highways or other public passages, all stemming from two separate incidents on Aug. 25. Barton granted the withdrawal of the disorderly conduct and obstruction of highways charges on Oct. 23, but Omeragic pleaded guilty to the public drunkenness charge and was fined approximately $340. The DUI charge was waived for a Jan. 14 hearing at the Allegheny County Courthouse and will now be part of a March 6 docket conference.

 

  • Whitehall police charged Joshua Gunter, 24, of 455 Streets Run Rd. in Whitehall, with  on Nov. 19. Barton held Gunter's charges on Nov. 27, and he faced them at the Allegheny County Courthouse on Jan. 15. He will now have a Feb. 15 pretrial conference.

 

  • Whitehall police charged Bradley Everett Haas Jr., 24, of 812 Rolling Rock Rd. in Baldwin Township, with public intoxication and disorderly conduct on June 29. Barton dismissed those charges on Jan. 16.

 

  • Whitehall police charged Michael Fazio, 22, of 1838 Parkline Dr., Apt. 13, in the Prospect Park area, with simple assault, harassment and disorderly conduct; Daniel Laplace Jr., 23, of 649 Glowood Dr. in Whitehall, with aggravated assault, disorderly conduct, simple assault and harassment; and Raymond Fleisner, 21, of 1556 Barnes Ave. in South Park Township, and Nathan Reed, 18, of 352 Benson Cir. in Whitehall, with disorderly conduct, all stemming from an incident at Caste Village on June 29. ... 

 

  • ... On Aug. 21, Barton granted the withdrawal of Fazio's assault charge, but his remaining charges were waived for an Oct. 4 hearing at the Allegheny County Courthouse. Fazio then had a Nov. 9 pretrial conference, which led to a Jan. 23 non-jury trial, where he pleaded guilty to his disorderly conduct and harassment charges and was sentenced to complete 90 days of probation and a drug & alcohol evaluation. ... 

 

  • ... On Aug. 28, Barton granted the withdrawal of Laplace's aggravated assault charge, but his remaining charges were waived for an Oct. 12 hearing at the Allegheny County Courthouse. Laplace then had a Nov. 21 pretrial conference, which also led to a Jan. 23 non-jury trial, where he pleaded guilty to his disorderly conduct and harassment charges and was sentenced to complete 90 days of probation, a drug & alcohol evaluation and an anger management program. And his simple assault charge was withdrawn. ... 

 

  • ... On Sept. 5, Barton found Reed guilty of his charge and fined him approximately $240. ... 

 

  • ... And Fleisner faced his charge before Barton on Sept. 14. He was found guilty and fined approximately $240, as well.

 

  • Whitehall police charged Matthew Russell Kim, 24, of 223 Augusta St. in Pittsburgh's Mt. Washington neighborhood, with  on April 8. Kim's April 17 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on June 5. He then had an Aug. 17 pretrial conference and a non-jury trial starting on Oct. 24. The unauthorized use of a vehicle and providing false identification charges were withdrawn, but Kim pleaded guilty to the receiving stolen property charge and was sentenced to restitution, fines of an undisclosed amount, an 18-month individualized program plan and 12 months of probation.
