Results from Magisterial District Court 05-2-17
Judge Barton's jurisdiction includes Whitehall Borough and Baldwin Township.
The following results are from recent hearings held in the Caste Village office of Magistrate David J. Barton of District Court 05-2-17:
- Whitehall Borough police charged William Salerno, 37, of 200 Sunny Dr. in Baldwin Borough, with simple assault, harassment and disorderly conduct on Aug. 23. After completing anger management classes at the Domestic OutReach Center, Salerno faced those charges at Barton's office on Feb. 28. His charges were dismissed.
- Whitehall Borough police charged Christopher Carr, 39, of 1691 Skyline Dr., Apt. 7, in Whitehall's Wallace (Prospect) Park area, with burglary, theft, receiving stolen property, criminal mischief and forgery and Lisa Marie Victorelli, 39, of 1691 Skyline, Apt. 6, with forgery, criminal conspiracy and possession of a controlled substance, all stemming from a late November incident. Carr's criminal mischief charge was withdrawn on Dec. 13, but his remaining charges were all waived for court. He faced those charges at the Allegheny County Courthouse on Feb. 1 and moved on to a March 16 pretrial conference, where he was scheduled for a non-jury trial to begin on May 22 (UPDATE: Continued to July 10). Victorelli's Jan. 31 hearing before Barton was waived, and she faced her charges at the Allegheny County Courthouse on March 19. She will now have a May 11 pretrial conference.
- Whitehall police charged Brian Fields, 34, of 131 Merritt Ave. in Pittsburgh's Carrick neighborhood, with retail theft on Jan. 4. Barton withdrew that charge on March 20.
- Whitehall police charged Melvin Augustino Dias, 25, of 407 Russellwood Ave. in McKees Rocks Borough, with possession of marijuana, possession of drug paraphernalia and possession of marijuana with intent to deliver on Jan. 6. Dias' Feb. 7 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on March 26. He will now have a pretrial conference on April 27.
- Whitehall police charged Rayshon Shields, 19, of 69 Harwood St. in Pittsburgh's Allentown neighborhood, with receiving stolen property (auto), providing false identification to law enforcement and careless driving on Oct. 10. Barton held those charges on Oct. 25, and Shields faced a Dec. 14 hearing at the Allegheny County Courthouse. Shields then faced a pretrial conference on Feb. 3, where it was determined that he would have a non-jury trial starting on March 29. Shields pled guilty to his charges at that trial and was sentenced to 172 days of time already served in confinement and two years of probation.
- Whitehall police charged Stephen Michael Fazio, 29, of 1826 Parkline Dr. in the Prospect Park area, with burglary and criminal trespass on Dec. 16. Barton held Fazio's charges at a Jan. 3 hearing, and Fazio faced those charges at the Allegheny County Courthouse on Feb. 21. He then had a pretrial conference on March 30, where he was scheduled for a non-jury trial to begin on June 11.
- Whitehall police charged Janet Lynn Peters, 32, of 2117 Brownsville Rd., Apt. 35B, in Carrick, with theft and receiving stolen property on Feb. 21. Barton withdrew those charges on April 3.
- Whitehall police charged Nathan Vincent Contosta, 32, of 238 Cedar St. in Baldwin Borough, with simple assault and harassment on Nov. 15. Barton held Contosta's charges at a Feb. 28 hearing, and Contosta faced those charges at the Allegheny County Courthouse on April 5. He will now have a pretrial conference on May 11.
- Whitehall police charged James Pierre Scott Jr., 22, of 2155 Elmore Sq. in Pittsburgh's Terrace Village neighborhood, with possession of marijuana on March 3. Barton withdrew that charge on April 17.
- Whitehall police charged Zachary Mielcarek, 19, of 1701 Parkline Dr., Apt. 12, in the Prospect Park area, with simple assault on Aug. 20. Mielcarek's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Jan. 11. Mielcarek then faced a pretrial conference on Feb. 17, where it was determined that he would have a non-jury trial starting on April 23. Mielcarek pled guilty to his charge at that trial and was sentenced to eight months of probation.
- Whitehall police charged Matthew Russell Kim, 24, of 223 Augusta St. in Pittsburgh's Mount Washington neighborhood, with receiving stolen property, unauthorized use of a vehicle and providing false identification to police on April 8. Kim's April 17 hearing before Barton was waived, and he will face those charges at the Allegheny County Courthouse on June 5.
- Baldwin Township police charged Christina Macsurak, 36, of Perri Drive in Baldwin Township, with drug possession (heroin) on Dec. 14. Macsurak's March 20 hearing before Barton was waived, and she will face that charge at the Allegheny County Courthouse on May 8.
- Baldwin Township police charged Hubert Walko, 43, of Saranac Avenue in Pittsburgh's Beechview neighborhood, with driving under the influence of alcohol, failure to drive on the right side of the road and failure to obey traffic controls on Feb. 5. Walko's March 20 hearing before Barton was waived, and he will face those charges at the Allegheny County Courthouse on May 8.
- Baldwin Township police charged George Tilley, 53, of Royal Oak Road in Scott Township, with DUI, possession of a controlled substance, speeding, failure to drive on the right side of the road, failure to obey traffic controls and attempting to elude police on Feb. 4. Tilley's March 27 hearing before Barton was waived, and he will face those charges at the Allegheny County Courthouse on May 15.
- Baldwin Township police charged Jennifer Irwin, 31, of McRoberts Road in Castle Shannon Borough, with drug possession on Sept. 24. Irwin's Dec. 20 hearing before Barton was waived, and she faced that charge at the Allegheny County Courthouse on Feb. 8. Her case was then part of a docket conference scheduled for March 28. Irwin pled guilty during that conference and was sentenced to six months of probation.
- Baldwin Township police charged Scott Crawford, 42, of Mississippi Avenue in Dormont Borough, with DUI after Crawford crashed his vehicle into a utility pole on Dewalt Drive on Aug. 12. Crawford's Oct. 11 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Feb. 9. Crawford was granted an accelerated rehabilitative disposition (ARD) hearing to begin on April 5. He was sentenced to 12 months of probation.
- Baldwin Township police charged Jared McKee, 26, of Mattern Avenue in Dormont, with DUI on Dec. 11. McKee's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on April 9. His case will now be part of a docket conference scheduled for May 22. That conference should result in the next legal step for McKee's charge.
- Baldwin Township police charged Brandon Bostocky, 34, of Bristol Street on the border of Pittsburgh's Hazelwood and Greenfield neighborhoods, with DUI on Jan. 4. Bostocky's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on April 9. His case will now be part of a docket conference scheduled for May 9. That conference should result in the next legal step for Bostocky's charge.
- Baldwin Township police charged Ian Livingston, 28, of Chelton Avenue in Pittsburgh's Brookline neighborhood, with DUI on Jan. 15. Livingston's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on April 9. Livingston was granted an ARD hearing to begin on May 18.
- Baldwin Township police charged Anthony Yost, 49, of Jacob Street in Pittsburgh's Overbrook neighborhood, with DUI, driving with a suspended license and failure to drive on the right side of the road on June 18. Yost faced those charges at the Allegheny County Courthouse on Dec. 12, where it was determined that his case would then be part of a docket conference scheduled for Jan. 17. Yost pled guilty to the DUI charge during that conference and, on April 11, was sentenced to four days of confinement. His other charges were withdrawn.
- Baldwin Township police charged Joseph Rotunda, 23, of Biltmore Avenue in Dormont, with DUI on Sept. 25. Rotunda's Jan. 10 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Feb. 28. His case was then part of a docket conference scheduled for April 11. Rotunda pled guilty during that conference and was sentenced to complete a 90-day individualized program plan and 18 months of probation.
- Baldwin Township police charged Rebecca McGuffey, 42, of Milbeth Drive in Mt. Lebanon, with DUI and three counts of failure to drive on the right side of the road on Jan. 8. McGuffey's Feb. 28 hearing before Barton was waived, and she faced those charges at the Allegheny County Courthouse on April 16. McGuffey was granted an ARD hearing to begin on June 13.
