Results from Magisterial District Court 05-2-17

Judge Barton's jurisdiction includes Whitehall Borough and Baldwin Township.

The following results are from recent hearings held in the Caste Village office of Magistrate David J. Barton of District Court 05-2-17:

 

  • Whitehall Borough police charged Dustin David Tichenor, 22, of 1145 McCartney St. in Pittsburgh's West End neighborhood, with harassment, and Charles Rafalowski, 45, of 2201 Hobson St. in Pittsburgh's Brookline neighborhood, with harassment, disorderly conduct and public intoxication, both from the same incident—a fight in front of Frank's Shoes at Caste Village on Sept. 11. Barton dismissed each of Rafalowski's charges on Dec. 19 but found Tichenor guilty on Jan. 20 and fined him approximately $330.

  • Whitehall police charged Zachary Mielcarek, 19, of 1701 Parkline, Apt. 12, in Whitehall, with simple assault on Aug. 20. Mielcarek's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Jan. 11. Mielcarek will now have a pre-trial conference on Feb. 17.

 

 

 

  • Baldwin Township police charged Charles Greenwald, 23, of Skyline Drive in Whitehall, with DUI on Sept. 24. Greenwald's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Jan. 11. Greenwald was granted an accelerated rehabilitative disposition (ARD) hearing to begin on Feb. 24.

 

  • Baldwin Township police charged Ryan Fogarty, 34, of Lexington Drive in Lawrence, PA, with DUI on Sept. 24. Fogarty's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Jan. 11. Fogarty will now have a pre-trial conference on March 2.

 

  • Baldwin Township police charged Gentry Zollars, 25, of Stonewood Drive in Bethel Park, with suspicion of DUI on July 30. Zollars was also charged with speeding and with failure to drive on the right side of the road. Zollars' Sept. 27 hearing before Barton was waived, and while the speeding charge was withdrawn, he faced the other charges at the Allegheny County Courthouse on Nov. 15. Zollars was sentenced to 12 months of probation—and the failure to drive on the right side of the road charge was withdrawn—at an ARD hearing on Jan. 13.
