Results from Magisterial District Court 05-2-17
Judge Barton's jurisdiction includes Whitehall Borough and Baldwin Township.
The following results are from recent hearings held in the Caste Village office of Magistrate David J. Barton of District Court 05-2-17:
- Whitehall Borough police charged Brenton Fawcett, 36, of 353 Brookline Blvd. in Pittsburgh, with retail theft on Sept. 22. Barton held that charge on Nov. 1, and Fawcett faced a Dec. 21 hearing at the Allegheny County Courthouse. He then faced a motions court on May 3, where it was determined that his case would be part of a June 6 docket conference. Fawcett pleaded guilty and was sentenced to 90 days of probation.
- Whitehall police charged Melvin Augustino Dias, 25, of 407 Russellwood Ave. in McKees Rocks Borough, with possession of marijuana, possession of drug paraphernalia and possession of marijuana with intent to deliver on Jan. 6. Dias' Feb. 7 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on March 26. He then had an April 27 pretrial conference and will now face a non-jury trial, starting on July 23.
- Whitehall police charged Amanda Krull, 22, of 59 Pearl Dr. in Brentwood Borough, with one count each of theft by deception, prohibited acts in charitable solicitation and soliciting without a permit from her actions on April 18. Krull's May 22 hearing before Barton was waived, and she will face those charges at the Allegheny County Courthouse on July 20.
- Whitehall police charged Arman Aslanyan, 19, of 3269 Library Rd. in Castle Shannon Borough, with possession of a controlled substance and drug paraphernalia on March 28. Barton withdrew those charges on May 8.
- Whitehall police charged Casey Edward Jones, 18, of 605 Highview Dr. in Baldwin Township, with possession of marijuana on April 4. Barton withdrew that charge on May 8.
- Whitehall police charged Nathan Vincent Contosta, 32, of 238 Cedar St. in Baldwin Borough, with simple assault and harassment on Nov. 15. Barton held Contosta's charges at a Feb. 28 hearing, and Contosta faced the charges at the Allegheny County Courthouse on April 5. He then had a May 11 pretrial conference and will now face a non-jury trial, starting on July 24.
- Whitehall police charged Ryan Ahrens, 39, of 3216 Mayflower Dr. in Whitehall, with violating a borough ordinance on April 14 that prohibits excessive animal noise. Ahrens faced that charge in front of Barton on May 11, was found guilty and was fined approximately $100.
- Whitehall police charged Brent Woods, 24, of 1838 Parkline Dr., Apt. 29, in Whitehall's Wallace (Prospect) Park area, with possession of marijuana and drug paraphernalia on April 3. Barton withdrew those charges on May 15.
- Whitehall police charged Christopher Carr, 39, of 1691 Skyline Dr., Apt. 7, in the Prospect Park area, with burglary, theft, receiving stolen property, criminal mischief and forgery and Lisa Marie Victorelli, 39, of 1691 Skyline, Apt. 6, with forgery, criminal conspiracy and possession of a controlled substance, all stemming from a late November incident. Carr's criminal mischief charge was withdrawn on Dec. 13, but his remaining charges were all waived for court. He faced those charges at the Allegheny County Courthouse on Feb. 1 and moved on to a March 16 pretrial conference, where he was scheduled for a non-jury trial to begin on May 22. The non-jury trial has been continued to July 10. Victorelli's Jan. 31 hearing before Barton was waived, and she faced her charges at the Allegheny County Courthouse on March 19. She then had a May 11 pretrial conference, and her charges were withdrawn.
- Whitehall police charged Ar Win, 33, of 1696 Skyline, Apt. 3, with assault and harassment on Feb. 18. Barton withdrew those charges on June 5.
- Whitehall police charged Matthew Russell Kim, 24, of 223 Augusta St. in Pittsburgh's Mount Washington neighborhood, with receiving stolen property, unauthorized use of a vehicle and providing false identification to police on April 8. Kim's April 17 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on June 5. He will now have a pretrial conference on Aug. 17.
- On April 11, Whitehall police charged Keith Grimm, 29, of 49 Rostock St. in Pittsburgh's Spring Hill-Cityview neighborhood, with making a false statement to police, providing false identification to police and identity theft—all stemming from a March 2 incident. Barton withdrew those charges on June 5.
- Whitehall police charged Stephen Michael Fazio, 29, of 1826 Parkline, with burglary and criminal trespass on Dec. 16. Barton held Fazio's charges at a Jan. 3 hearing, and Fazio faced those charges at the Allegheny County Courthouse on Feb. 21. He then had a March 30 pretrial conference, where he was scheduled for a non-jury trial to begin on June 11. The burglary charge was withdrawn, but Fazio pleaded guilty to the criminal trespass charge and was sentenced to between 11.5 and 23 months of confinement as well as three years of probation.
- Whitehall police charged Eugenio Pratts, 21, of 1481 Maple Dr., Apt. 4, in the Prospect Park area, with possession of a controlled substance on Jan. 17. Pratts pleaded guilty in front of Barton on April 19 and was fined approximately $200.
- On April 10, Whitehall police charged James Schenck, 51, of 324 Benson Cir. in Whitehall, with trespass by a motor vehicle and failure to report damage to unattended property—both stemming from an April 9 incident. Barton withdrew the charges on May 30.
- Whitehall police charged Steven Evans, 55, of 1745 Skyline, Apt. 60, with disorderly conduct on May 5. Evans faced that charge in front of Barton on June 20, was found guilty and was fined approximately $165.
- Baldwin Township police charged Daniel Winnowski, 30, of Edgeridge Road in Baldwin Township, with disorderly conduct and public intoxication on Dec. 4. Barton withdrew the charges on May 1.
- Baldwin Township police charged Jonathan Rakestraw, 27, of Linda Drive in Brookline, with driving under the influence of alcohol on Dec. 9. Rakestraw's Jan. 31 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on March 19. He was granted a May 1 accelerated rehabilitative disposition (ARD) hearing, where he was sentenced to four days of confinement.
- Baldwin Township police charged Ryan Fogarty, 34, of Lexington Drive in Lawrence, PA, with DUI on Sept. 24. Fogarty's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on Jan. 11. Fogarty then had a March 2 pretrial conference and a May 8 plea hearing. He pleaded guilty and was sentenced to between 30 and 60 days of confinement as well as six months of probation.
- Baldwin Township police charged Jeffrey Colaizzi, 30, of Vernon Avenue on the border of Brentwood and Baldwin boroughs, with DUI and possession of both a controlled substance and drug paraphernalia on March 22. Colaizzi's May 8 hearing before Barton was waived, and he will face those charges at the Allegheny County Courthouse on Aug. 6. (UPDATE: Rescheduled for Sept. 4.)
- Baldwin Township police charged Christina Macsurak, 36, of Perri Drive in Baldwin Township, with drug possession on Dec. 14. Macsurak's March 20 hearing before Barton was waived, and she faced that charge at the Allegheny County Courthouse on May 8. Her case was then part of a June 4 docket conference. Macsurak pleaded guilty and was sentenced to six months of probation.
- Baldwin Township police charged Hubert Walko, 43, of Saranac Avenue in Pittsburgh's Beechview neighborhood, with DUI, failure to drive on the right side of the road and failure to obey traffic controls on Feb. 5. Walko's March 20 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on May 8. He was granted a June 13 ARD hearing, and the traffic charges were dismissed. Walko also entered a six-month ARD program, and should he complete the program, the DUI charge will also be dismissed.
- Baldwin Township police charged Daniel Smaglo, 40, of Beltram Avenue in Baldwin Township, with possession of a controlled substance on Feb. 10. Smaglo's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on May 9. His case was then part of a June 6 docket conference. Macsurak pleaded guilty and was sentenced to 12 months of probation.
- Baldwin Township police charged George Tilley, 53, of Royal Oak Road in Scott Township, with DUI, possession of a controlled substance, speeding, failure to drive on the right side of the road, failure to obey traffic controls and attempting to elude police on Feb. 4. Tilley's March 27 hearing before Barton was waived, and he faced those charges at the Allegheny County Courthouse on May 15. He then had a June 22 pretrial conference and will now have a non-jury trial, starting on Oct. 29.
- Baldwin Township police charged Zachary Ostrowski, 24, of Highview Road in Baldwin Township, with DUI on Sept. 24. Ostrowski's Nov. 22 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on March 14. He was granted a May 18 ARD hearing, and he entered a six-month ARD program. Should Ostrowski complete the program, his charge will be dismissed.
- Baldwin Township police charged Todd M. Beckett, 44, of Arkansas Avenue in Dormont Borough, with DUI on Nov. 12. Beckett's Jan. 31 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on March 19. He was granted a May 18 ARD hearing, and he entered a 12-month ARD program. Should Beckett complete the program, his charge will be dismissed.
- Baldwin Township police charged Paul Schuetz, 29, of Brookline Boulevard, on Dec. 28 with breaking into a vehicle and stealing loose change on Nov. 25. Schuetz pleaded guilty before Barton on April 17 to a criminal mischief charge. A theft from motor vehicle charge was withdrawn on May 18.
- Baldwin Township police charged Ian Livingston, 28, of Chelton Avenue in Brookline, with DUI on Jan. 15. Livingston's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on April 9. Livingston was granted a May 18 ARD hearing, and he entered a 12-month ARD program. Should Livingston complete the program, his charge will be dismissed.
- Baldwin Township police charged Jared McKee, 26, of Mattern Avenue in Dormont, with DUI on Dec. 11. McKee's Feb. 21 hearing before Barton was waived, and he faced that charge at the Allegheny County Courthouse on April 9. His case was then part of a May 22 docket conference, and he will now face a non-jury trial, starting on Aug. 3. (UPDATE: Trial continued to Sept. 13.)
- Baldwin Township police charged Rebecca McGuffey, 42, of Milbeth Drive in Mt. Lebanon, with DUI and three counts of failure to drive on the right side of the road on Jan. 8. McGuffey's Feb. 28 hearing before Barton was waived, and she faced those charges at the Allegheny County Courthouse on April 16. McGuffey was granted a June 13 ARD hearing, and the traffic charges were dismissed. She also entered a 12-month ARD program, and should she complete the program, the DUI charge will also be dismissed.
- Baldwin Township police charged Jeffrey Marston, 21, of Frich Drive in Whitehall, with disorderly conduct, resisting arrest and DUI on March 18. Barton withdrew the resisting arrest charge on May 15, but Marston will face the remaining charges at the Allegheny County Courthouse on June 29.
- Baldwin Township police charged Linda Nania, 41, of 1257 McNeilly Ave. in Dormont, with DUI on April 27. Nania's June 5 hearing before Barton was waived, and she will face that charge at the Allegheny County Courthouse on July 20.
